It's complicated. First, you don't want to do anything with them without IP assignments. Second, your friends probably won't sign away their IP without some ownership assignment or payment. If you don't pay them, this implies you form a company and assign the IP to it with shares in payment to the partners.

You can form a partnership or LLC pretty easily, although you should do a C corp if you are planning on raising money from an investor or entity that itself is a LLC, S corp, or C corp.

The stuff iolothebard mentions will be covered by the attorney when forming the company.

On the phone with them right now and they are denying me the ability to bring it in. While there are some who say Apple's service is fantastic, I've run into this time and time again. As they get bigger, their customer service gets worse. You are screwed if it's out of warranty.

The only reason EULAs exist is because they can exist. If you required people to sign a EULA when they bought a watch, nobody could get away with it. Because it's software, and you can show this type of information quickly and ask for an affirmative from the user, you can.

Step #1, stop being secretive about it! Being secretive with ideas makes no sense unless you have some crazy ass IP associated with it, or it's timing related. While posting an idea in an internet forum may seem counter intuitive, it's actually a good way to quickly work out the flaws in your revenue model, go to market, etc. Remember, it's not the idea, it's the execution! I've got plenty of ideas, it's the execution on them that's a beast.

Step #2, figure out risks. Regarding the fact you searched and didn't find anything on the Internet, I would say it's more likely that someone has tried it, and there's either no viable revenue, or the market is so small it can't maintain it. That nobody would pay for it, and the providers are cheap isn't a good sign either. If you were an expert in the market, you might know the answer to this. Can you talk to one about it?

Step #3, size the market. Calculate the average number of providers in the US, then figure out how much they make on average per year. Multiple to get the yearly market size. Ask yourself if, at scale, there is anyway you can get a portion of the pie, and if yes, how much.

A friend and I were discussing this a few weeks ago. The "science" that Mythbusters practices may not be completely solid, but their presentation more than makes up for it. If you manage to get young people involved in science by watching you blow up shit, more power to you!

Both Doug's and Dupin melt when you have > 10K songs. I ended up rolling my own solution, which involved deduping at the file level first (using Python too look for files with the same MD5) then looking for songs with the same approximate time length using Python via the iTunes API (only on Windows, sigh). This gave me a vague idea of possible duplicates, which I then manually deleted. Took forever.

The "realtime" search concept is pure hype. Every search engine in business today works on shortening their crawl and index times to increase relevancy. The age of the content plays a big part in this.

Keyboardr uses Google to do "live" searches. It's just shooting off search requests as you type.

Yeah, trademark registration doesn't work that way. It takes at least a year to file and get it issued. You are looking at the issue date, not the filing date on the trademark search page. Edit: I have a trademark that was filed months before the "filing date" on the trademark search page. The "filing date" in my case was the actual issue date, if that makes sense.

I've done a bit of digging around recently about trademarks because of this problem. It's fairly complicated.

The first thing to realize is that the logo marks are typically separate trademarks. Stating the SPARC and Sparkfun logos are different is obvious. It's the name itself, sparkfun or sparc, that is being presented as a basis for infringement. Simply put, if they sound the same, there is an argument for market confusion, especially if they share the same classification.

I'd be a bit worried if I were them. If you registered a mark like "mikrosoftfun" wouldn't you expect to be called on the carpet by Microsoft?
